Welcome to Element Guard (accessible via our store website). These Terms of Service ("Terms") govern your use of our website, services, and the purchase of any products from our online store.

By accessing our website or purchasing a product from us, you engage in our "Service" and agree to be bound by the following terms and conditions. Please read these Terms carefully before placing an order.

1. General Conditions & Australian Consumer Law

Our store operates in accordance with the Australian Consumer Law (ACL) under the Competition and Consumer Act 2010 (Cth). Nothing in these Terms excludes, restricts, or modifies any statutory rights, guarantees, or remedies you are entitled to under the ACL that cannot be lawfully excluded.

We reserve the right to refuse service to anyone for any reason at any time, subject to applicable Australian law.

2. Products, Sizing, and Specifications

Product Descriptions: We make every effort to display as accurately as possible the colors, dimensions, and specifications of our heavy-duty covers. However, actual colors may vary depending on monitor displays, and manufacturing dimensions may have minor tolerances (+/- 2–5cm).
Fitment & Sizing Responsibility: Customers are responsible for correctly measuring their caravan, pop-top, boat, or trailer prior to purchase. Measurement guides on our website specify measuring the vehicle body length (excluding drawbars/A-frames) and accounting for rooftop accessories (A/C units, TV antennas, solar panels, and rear spare tires).
Product Modifications: We reserve the right to discontinue any product or modify specifications without prior notice.

3. Proper Usage & Customer Obligations

To ensure the longevity of your cover and prevent accidental vehicle damage:

Sharp Edge Protection: Customers must adequately pad or cover all sharp protrusions, gutter spouts, solar panel corners, roof racks, and TV antennas before installing a cover. Tearing caused by sharp edges during installation or wind movement is not considered a manufacturing defect.
Vehicle Surface Preparation: Vehicles must be thoroughly cleaned and dried prior to cover installation. Road grit, sand, or debris trapped underneath a cover can act as an abrasive during wind movement.
Secure Installation: All tie-down straps and buckles must be properly tightened and secured. Loose or flapping covers in high-wind conditions can suffer stress tears and cause friction rub on vehicle paintwork.

4. Limitation of Liability & Consequential Damage Disclaimer

To the maximum extent permitted by the Australian Consumer Law:

No Consequential Loss: Element Guard, its directors, officers, employees, or suppliers shall not be liable for any indirect, incidental, special, or consequential damages resulting from the use or inability to use our products.
Vehicle Damage: Element Guard is not liable for paint scuffs, surface abrasion, moisture/mildew buildup, or structural damage to caravans, boats, trailers, or accessories resulting from:
- Failure to clean the vehicle prior to installation.
- Inadequate padding of sharp corners or edges.
- Improper tensioning of straps or failure to secure the cover during severe weather events.
- Natural weathering, prolonged UV exposure, or extreme storm/cyclonic conditions beyond normal product design limits.
Insurance Notice: Element Guard protective covers are wear-and-tear protective barriers and are not a substitute for comprehensive vehicle or property insurance.

5. Orders, Pricing, and Payments

Pricing: All prices displayed on our store are in Australian Dollars (AUD) and include Goods and Services Tax (GST) where applicable.
Price Changes: We reserve the right to adjust pricing or shipping charges at any time without prior notice. Price changes will not affect orders that have already been confirmed.
Order Acceptance: Receipt of an order confirmation does not signify our final acceptance of your order. We reserve the right to cancel or refuse any order (e.g., in the event of suspected fraud, pricing errors, or stock unavailability). If an order is canceled after payment, a full refund will be issued immediately.

6. Shipping & Delivery

Fulfillment: Orders are dispatched from Australian fulfillment facilities. Estimated delivery timeframes provided at checkout are estimates only and are not guaranteed delivery dates.
Transit Risk: Title and risk of loss pass to you upon delivery of the items to your nominated address by the carrier.
Incorrect Address: Customers are responsible for providing complete and accurate shipping addresses. Re-consignment or re-delivery fees resulting from incorrect address details entered at checkout are the responsibility of the customer.

7. Returns, Refunds, and Warranty Claims

All returns, change-of-mind exchanges, and 12-Month Warranty claims are handled in strict accordance with our dedicated Return & Refund Policy. Please review our Return Policy for full details on how claims are processed and evaluated under the ACL.

8. Intellectual Property

All content on this website—including logos, product descriptions, images, graphics, text, and design elements—is the intellectual property of Element Guard and protected under Australian and international copyright and trademark laws. You may not reproduce, duplicate, or exploit any portion of the content without express written consent.

9. Governing Law

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the State of Queensland, Australia, and you submit to the non-exclusive jurisdiction of the courts of Queensland.
